Terms of Service

1. Who these terms are with

Пасьянс.укр (the Service) is a website at пасьянс.укр, formerly 9online.cards, where you can play free card games in a web browser: Klondike solitaire and the multiplayer card game Nine Online. It is a non-commercial project operated by Roman Zaiats in Austria (“we”, “us”).

By opening the Service you agree to these Terms. If you do not agree, do not use it. Our Privacy Policy explains how we handle your data and forms part of these Terms.

2. Who may play

You must be at least 13 years old. If the law where you live sets a higher age for agreeing to online terms without a parent’s consent, you must meet that age instead, or have that consent.

You may not use the Service if we have previously terminated your access.

3. Your account

Guest accounts. Solitaire can be played without an account. For Nine Online, the Service creates an account for you automatically the first time you play, so that you can play without signing up. A guest account lives in your browser’s storage. Clearing that storage, or switching browser or device, makes it unreachable — its progress, coins and history are then lost. This is a consequence of how guest play works, not something we can restore.

Signed-in accounts. You can attach an email address, or use “Sign in with Apple”. Signing in from a guest session merges that session’s progress into your account. Signing in preserves your progress across devices; we recommend it if your progress matters to you.

You are responsible for keeping access to the email address or Apple ID you sign in with. Anyone who can read your email can request a sign-in code and reach your account.

One account per person. Do not create multiple accounts to farm invite rewards, daily bonuses or leaderboard position.

4. Coins and rewards

Coins, XP, levels, daily bonuses, invite rewards and mission rewards are virtual items with no monetary value. Specifically:

• They cannot be bought, sold, exchanged for money, or cashed out.
• They are not your property; they are a limited, revocable, non-transferable licence to use them inside the Service.
• We may adjust, reset or remove balances — for example to correct a bug, to reverse rewards obtained by abuse, or when we rebalance the game.
• They carry no value if your account is closed or the Service ends.

The Service is currently free and contains no purchases and no advertising. If that changes, we will publish updated terms before it takes effect.

This is not gambling. Nothing in the game may be won or lost for real money or anything of real-world value.

5. Fair play

You agree not to:

• use bots, scripts, automation, modified clients or any tool that plays for you or reads other players’ hidden cards;
• exploit a bug, glitch or unintended behaviour instead of reporting it to [email protected];
• collude with other players to transfer coins or fix the outcome of a game;
• create multiple or fake accounts, including to claim invite or referral rewards for yourself;
• interfere with the Service — probing, scraping, overloading, reverse engineering it, or bypassing rate limits and authentication;
• choose a display name or avatar that is abusive, hateful, sexual, deceptive (for example impersonating us or another player), or unlawful;
• harass other players, or use invitations and friend requests to send them unsolicited messages.

Some opponents in the Service are automated players. This is part of the game design and is not a defect.

6. What you provide

You choose your display name and avatar. You are responsible for them, and you grant us a non-exclusive, worldwide, royalty-free licence to display them to other players and in the Service’s own screens (leaderboards, player search, history, invitations) for as long as your account exists. We may change or reset a display name that breaks section 5.

7. Invitations

Invite links let you bring people to the Service and may earn both of you rewards. Send them only to people who would want to receive them. We may withhold or reverse invite rewards where the invitations look automated, self-referred or otherwise abusive.

8. Notifications

We send emails for sign-in codes and, if you turn them on, for friend requests and table invitations. Browser push notifications are sent only if you allow them. Both can be turned off in your profile or in your browser at any time. Sign-in code emails are transactional and cannot be turned off while you use email sign-in.

9. Availability and changes

The Service is provided as it is and as available. We may change, suspend or discontinue any part of it, add or remove features, change game rules, balances and economy, or take it offline for maintenance, without notice. We do not guarantee that the Service will be uninterrupted, error-free, or that game history and progress will always be preserved.

10. Suspension and termination

We may suspend or terminate your access, and remove an account and its coins, if you break these Terms or if we reasonably suspect fraud, abuse or activity that harms other players or the Service.

You may stop using the Service at any time. To have your account and personal data deleted, email [email protected] from the address on the account; see the Privacy Policy for what happens then.

11. Third-party services

The Service relies on providers including hosting, email delivery, database hosting, error monitoring, “Sign in with Apple” and browser push services. We are not responsible for their availability or their own terms.

12. Disclaimer of warranties

To the fullest extent permitted by law, the Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including fitness for a particular purpose, merchantability, non-infringement, or that the Service will be secure or uninterrupted.

13. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special or consequential damages, nor for lost coins, progress, game history, or data. The Service is free of charge; where liability cannot be excluded, our total liability to you is limited to the amount you have paid us for the Service, which is zero, or the minimum amount the applicable law requires.

Nothing in these Terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law. If you are a consumer, you keep all mandatory rights the law of your country of residence gives you, and nothing here overrides them.

14. Indemnity

You agree to indemnify us against claims, damages and reasonable costs arising from your use of the Service in breach of these Terms or of the law. This does not apply where you are a consumer and the applicable law does not permit it.

15. Governing law and disputes

These Terms are governed by the laws of Austria, and disputes will be heard by the competent courts of Austria. If you are a consumer resident in the EEA or the UK, this does not deprive you of the protection of the mandatory law of your country of residence, and you may bring proceedings in your local courts.

16. Changes to these Terms

We may update these Terms. The version on this page, with the date at the top, is the one that applies. If a change materially affects your rights, we will give notice in the Service or by email before it takes effect. Continuing to play after a change means you accept the updated Terms.

17. General

If any provision is found unenforceable, the rest remains in force. Our not enforcing a provision is not a waiver of it. You may not transfer your rights under these Terms; we may transfer ours to a successor of the Service. These Terms, with the Privacy Policy, are the entire agreement between us about the Service.
